Terms of Service

Effective August 25, 2026  ·  Last updated August 25, 2026
Read this part if you read nothing else

Home Source is not a contractor. We do not repair roofs, service pools, install HVAC systems, or fix plumbing. We gather information about your project, show you an estimated cost range, and — if you approve it and choose a time — introduce your project to one independent contractor through the Blitz marketplace. Everything after that introduction is between you and that contractor.

The number is an estimateIt is generated by software from aerial imagery and your answers. It is not a bid, quote, or offer, and the contractor's real price after an in-person inspection may be higher or lower.
One contractor, not sevenWe hold your appointment window for a single contractor. We do not sell your information to a pool of callers.
You control contactYou tell us when to stop and we stop. Opt-out instructions are in Section 8 and they work by any reasonable method.
Disputes go to arbitrationSection 21 requires individual arbitration and waives class actions — but you have 30 days to opt out of that, in writing, with no effect on anything else.

1.Agreement to These Terms

These Terms of Service (the "Terms") are a binding contract between you and [REGISTERED LEGAL ENTITY NAME], an Arizona limited liability company doing business as Home Source ("Home Source," "we," "us," or "our"). They govern your access to and use of theonlyhomesource.com, any subdomain, and any page, form, estimating tool, measurement tool, booking flow, text message, or email we operate (together, the "Service").

By using the Service — including by opening a page, starting a form, submitting an estimate request, or approving an estimate — you agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Service.

1.1 Electronic agreement

You consent to transact with us electronically. Clicking a button labeled "I agree," "Approve," "Book," "Continue," or similar, or checking a consent box, is your electronic signature and has the same legal effect as a handwritten signature under the federal E-SIGN Act and the Arizona Electronic Transactions Act. You may withdraw this consent only by ceasing to use the Service; withdrawal does not unwind transactions already completed.

1.2 Capacity

You must be at least 18 years old and legally able to enter contracts. You represent that you either own the property you are requesting service for or have the property owner's authority to request estimates and schedule appointments for it. If you are acting for a business or another person, you represent that you are authorized to bind them, and "you" includes them.

2.What Home Source Is — and What It Is Not

Home Source is a lead-generation and appointment-referral service. Our role, completely stated, is this:

  1. We ask you questions about your property and your project.
  2. We estimate a likely cost range using published industry pricing data, third-party aerial and satellite measurement data, and the answers you give us.
  3. If you approve that range and select a date and arrival window, we package your project as a booked appointment and offer it to independent contractors through the Blitz marketplace at blitz-live.com.
  4. One contractor acquires that appointment and contacts you directly.
What we are not

Home Source is not a licensed contractor, roofer, plumber, pool service company, or HVAC company. We are not a general contractor, construction manager, engineer, architect, home inspector, insurance adjuster, public adjuster, or insurance producer. We are not a party to any agreement you enter with a contractor. We do not perform, supervise, inspect, direct, schedule the actual work of, warrant, guarantee, insure, or accept payment for any home services work.

2.1 Blitz is a separate marketplace

Blitz (blitz-live.com) is the marketplace where contractors bid on booked appointments. We supply appointments to Blitz. Contractor verification — licensing, insurance, bonding, background, and ratings — is performed through Blitz, under Blitz's own terms and standards, not by Home Source. Any description of a contractor as "licensed," "local," "top-rated," or similar reflects information reported to or verified by Blitz, and is not an independent representation, endorsement, certification, or guarantee by Home Source. We encourage you to independently confirm any contractor's license and insurance before work begins — in Arizona, through the Registrar of Contractors, and elsewhere through the equivalent state agency.

2.2 No agency

No agency, partnership, joint venture, franchise, employment, or fiduciary relationship exists between Home Source and any contractor, or between Home Source and you. Contractors are independent third parties. They are not our employees, agents, subcontractors, or representatives, and they have no authority to make any promise, warranty, or commitment on our behalf. Nothing a contractor says or does binds Home Source.

3.The Estimate Is Not a Quote

This section is the most important one in these Terms. Read it in full.

The cost range the Service displays (the "Estimate") is an automated, informational approximation. It is produced by software applying published industry cost ranges and pricing rules to the answers you provide and to third-party measurement data. No human inspected your property. No one climbed on your roof, opened a wall, pressure-tested a line, or looked inside your equipment.

The Estimate is not a binding offer

The Estimate is not a bid, quote, proposal, offer, contract, appraisal, insurance valuation, or guarantee of price. It creates no obligation for any contractor to perform work at that price, and no obligation for Home Source to procure work at that price. The final price is set solely by the contractor you hire, in a written contract between you and that contractor, after an on-site inspection. That price may be materially higher or materially lower than the Estimate.

3.1 Why the real price commonly differs

The Estimate cannot account for conditions that are only discoverable in person, including but not limited to: decking rot, structural damage, mold, prior repairs, layered or improperly installed roofing, undisclosed permits or code upgrades, homeowners-association or municipal requirements, historic-district rules, access and staging constraints, landscaping and property protection, hidden leaks, corroded or non-conforming plumbing, undersized electrical service, refrigerant type and line-set condition, equipment age and compatibility, pool surface and plumbing condition, water chemistry, seasonal labor and material pricing, tariffs, supply shortages, and post-storm demand surges. Material and labor markets move; an Estimate generated today may not reflect pricing next week.

3.2 Approving an Estimate is not a purchase

When you "approve" an Estimate, you are telling us the range is close enough that you want to meet a contractor. You are not buying anything, hiring anyone, authorizing any charge, or committing to any work. Home Source charges homeowners nothing. You are free to decline the contractor's actual bid for any reason or no reason.

3.3 Ranges, not prices

Estimates are presented as ranges. Where a single figure or midpoint appears, it is illustrative only and carries no greater weight than the range it summarizes.

4.Measurement Tools and Third-Party Property Data

The Service measures roofs, pools, and other property features using third-party aerial, satellite, and building-analysis data — including Google Maps Platform and the Google Solar API — and, in some flows, shapes you trace yourself on a satellite image.

Measurements produced by the Service are estimates for planning purposes only and are not a survey, engineering measurement, takeoff, appraisal, or certification. They must not be relied on for ordering materials, submitting insurance claims, pulling permits, bidding a job, or any other purpose requiring accuracy. Any contractor using these tools is solely responsible for independently verifying every measurement before quoting or ordering. Your use of Google-powered features is also subject to Google's Terms of Service and Privacy Policy.

5.Appointments and What "Held" Means

When you select a date and an arrival window, we reserve that window as a requested appointment and offer it to contractors through Blitz.

We may cancel, reassign, or decline to fill an appointment at our discretion — for example if the property falls outside a serviceable area, the request appears fraudulent or duplicative, the information provided is materially inaccurate, or no qualified contractor is available.

6.Your Information Must Be Accurate

You agree that everything you submit — name, address, phone number, email, property details, project descriptions, photographs, and timing — is truthful, accurate, and yours to provide. You represent that the phone number you give us is a number you own or are the customary user of, and that you are authorized to consent to calls and texts to it. You will promptly correct any information that becomes inaccurate, including if you give up or change the phone number.

Submitting another person's information without their authorization — including a neighbor's, a landlord's, a tenant's, or a competitor's — is a material breach of these Terms, may violate state and federal law, and you will be solely responsible for the consequences.

7.Your Content and the License You Give Us

You keep ownership of the photographs, descriptions, traced shapes, and other material you submit ("Your Content"). You grant Home Source a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to host, store, reproduce, adapt, and display Your Content for the purposes of operating the Service, generating your Estimate, packaging and transmitting your appointment to Blitz and to the acquiring contractor, resolving disputes, complying with law, and improving our estimating models. This license survives termination to the extent needed for those purposes.

You represent that you own or have all rights necessary to grant this license, and that Your Content does not infringe anyone's rights or violate any law. Do not upload anything containing other people's personal information, and do not upload anything you would not want shared with a contractor.

8.Consent to Calls, Texts, and Email — and How to Stop Them

By checking the consent box and submitting your information, you provide prior express written consent under the Telephone Consumer Protection Act (47 U.S.C. § 227) and applicable state telemarketing laws for Home Source and the one contractor who acquires your appointment to contact you at the phone number and email address you provided — including by automatic telephone dialing system, artificial or prerecorded voice, and SMS or MMS text message — about your request, your appointment, and the services you asked about.

Consent is not a condition of purchase

You are not required to agree to receive automated calls or texts in order to obtain an Estimate, and consenting is not a condition of purchasing any goods or services. You may request an Estimate and decline automated contact.

8.1 What consent covers

The specific parties authorized to contact you are identified to you at the point of consent. We do not sell your contact information to a general pool of marketers, and we do not distribute your request to multiple competing contractors for solicitation. Message frequency varies. Message and data rates may apply. We do not charge for messages; your carrier may.

8.2 Revoking consent

You may revoke consent at any time, for any reason, by any reasonable method, and you do not need to use any particular word or channel. Reasonable methods include:

We will honor a revocation as soon as practicable and in no event later than ten (10) business days after receipt. After you opt out of texts we may send a single confirmation message acknowledging the opt-out, and nothing further. Revoking marketing consent does not prevent us from sending a transactional message you specifically request. Reply HELP to any text for assistance.

8.3 Contractor contact

Opting out with Home Source stops our messages. If a contractor has already acquired your appointment, tell that contractor directly to stop contacting you — and tell us as well, so we can pass the request along. Each contractor is independently responsible for its own compliance with the TCPA, state telemarketing statutes, and do-not-call rules.

8.4 Recording

Calls with Home Source may be monitored or recorded for quality, training, and compliance. Where required, you will be notified at the start of the call. If you do not consent to recording, tell us and we will end the call or continue by another channel.

9.Fees

Home Source is free for homeowners. We never charge you a fee, commission, deposit, subscription, or markup for an Estimate, an appointment, or an introduction. We are paid by contractors, who purchase booked appointments through the Blitz marketplace. That payment is for the appointment itself; it is not a commission on your job, and it does not change what you pay a contractor.

Everything you pay for actual work is paid to the contractor, under a contract between you and the contractor, on terms you negotiate with the contractor. Home Source does not collect, process, hold, escrow, or refund those payments and has no ability to do so.

10.Your Relationship With the Contractor — and Release

Any agreement for work is solely between you and the contractor. Before you sign anything, we strongly encourage you to verify the contractor's license and insurance with your state licensing agency, obtain a written scope and price, confirm warranty terms, and understand your cancellation rights (many states give you three business days to cancel a home-solicitation sale).

Release

To the fullest extent permitted by law, you release Home Source, and our officers, members, managers, employees, and agents, from any and all claims, demands, damages, losses, costs, and expenses of every kind, known or unknown, arising out of or in any way connected with any dispute, transaction, interaction, or work involving you and any contractor, including workmanship, delay, non-performance, no-shows, property damage, bodily injury, overcharging, fraud, licensing or insurance failures, warranty disputes, liens, and code or permit violations.

If you are a California resident, you expressly waive California Civil Code § 1542, which reads: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." You waive any comparable statute or common-law principle in any other jurisdiction.

11.Terms for Contractors and Marketplace Participants

This section applies if you access the Service as a contractor, service provider, or their representative — including anyone using our roof-measuring tool.

12.Prohibited Conduct

You will not, and will not permit anyone else to:

We may investigate, suspend, or terminate access for any suspected violation, and may report conduct we believe is unlawful to the appropriate authorities.

13.Intellectual Property

The Service — including its design, text, graphics, layout, logos, the Home Source name and marks, our estimating methodology, pricing models, scoring logic, question flows, and all software — is owned by Home Source or our licensors and is protected by copyright, trademark, trade secret, and other laws. We grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your own personal or internal business use, consistent with these Terms. All rights not expressly granted are reserved. "Blitz" and third-party marks belong to their respective owners.

14.Third-Party Services and Links

The Service incorporates and links to third-party services, including Google Maps Platform, the Google Solar API, Blitz, analytics providers, and advertising platforms such as Meta. We do not control these services, do not endorse them, and are not responsible for their content, availability, accuracy, practices, or terms. Their terms and privacy policies govern your use of them. If a third-party service degrades, changes, restricts, prices, or discontinues its offering, features of the Service may change or stop working, and we will not be liable for that.

15.Service Availability

We may modify, suspend, limit, or discontinue any part of the Service at any time, with or without notice. We do not guarantee that the Service will be available, uninterrupted, timely, secure, or error-free, that defects will be corrected, or that any particular geography, trade, or feature will continue to be supported. We may impose limits on use or restrict access to specific regions or users.

16.Disclaimer of Warranties

The service, including every estimate, measurement, price range, availability indication, contractor introduction, and appointment, is provided "as is" and "as available," with all faults and without warranty of any kind.

To the fullest extent permitted by law, Home Source disclaims all warranties, express, implied, statutory, or otherwise, including any implied warranty of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and any warranty arising from course of dealing, course of performance, or usage of trade.

Without limiting the foregoing, Home Source does not warrant that any estimate is accurate or achievable; that any measurement is correct; that any appointment will be filled, kept, or honored; that any contractor is licensed, insured, bonded, competent, available, honest, or suitable; that any work will be performed at all, performed competently, or performed at any particular price; or that the service will be uninterrupted, secure, or free of errors, viruses, or harmful components.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you. In that case such warranties are limited to the minimum scope and shortest duration permitted by law. No advice or information, oral or written, obtained from Home Source creates any warranty not expressly stated here.

17.Limitation of Liability

To the fullest extent permitted by law, Home Source and our officers, members, managers, employees, agents, suppliers, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, goodwill, data, or use, or for any cost of substitute services, arising out of or relating to these terms or the service, whether based in contract, tort, negligence, strict liability, statute, or any other theory, and whether or not we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability for all claims arising out of or relating to these terms or the service will not exceed the greater of (a) the total amount you actually paid to Home Source in the twelve months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100.00). Because Home Source charges homeowners nothing, for most homeowners this cap is $100.00.

In no event will Home Source be liable for the acts, omissions, workmanship, pricing, delay, non-appearance, negligence, misconduct, property damage, bodily injury, or contract breach of any contractor, or for any dispute between you and a contractor.

These limitations apply even if a limited remedy fails of its essential purpose, and they form an essential basis of the bargain between us — without them, Home Source could not offer the Service at no cost to homeowners. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you; nothing here limits liability that cannot lawfully be limited, including liability for fraud, gross negligence, willful misconduct, or death or personal injury caused by our own negligence where such limitation is prohibited.

18.Indemnification

You will defend, indemnify, and hold harmless Home Source and our officers, members, managers, employees, agents, and licensors from and against any claim, demand, action, investigation, loss, liability, damage, penalty, fine, judgment, settlement, and expense (including reasonable attorneys' fees and costs) arising out of or relating to:

We may assume exclusive defense and control of any matter subject to indemnification, at your expense, and you will cooperate with us. You will not settle any matter in a way that imposes any obligation or admission on Home Source without our prior written consent.

19.Term and Termination

These Terms apply for as long as you use the Service. We may suspend or terminate your access at any time, for any reason or no reason, with or without notice, including for suspected breach. You may stop using the Service at any time. Sections 3, 6, 7, 8.2, 10, 12–14, and 16–24 survive termination, along with any other provision that by its nature should survive.

20.Changes to These Terms

We may update these Terms. When we do, we will change the "Last updated" date at the top and, for material changes, provide additional notice — such as an on-site banner or an email — at least fourteen (14) days before the change takes effect where practicable. Your continued use after the effective date means you accept the updated Terms. If you do not accept them, stop using the Service. Changes do not apply retroactively to a dispute of which we had actual notice on the date of the change. If we materially change Section 21, you may reject the change by notifying us in writing within thirty (30) days, in which case the prior version governs disputes arising before the change.

21.Dispute Resolution, Arbitration, and Class-Action Waiver

Please read this section carefully — it affects your legal rights

This section requires you and Home Source to resolve disputes by individual binding arbitration rather than in court, and waives your right to a jury trial and to participate in a class action. You have thirty (30) days to opt out. Opting out will not affect any other part of your relationship with Home Source.

21.1 Informal resolution first

Before starting an arbitration, you agree to first send a written Notice of Dispute to legal@theonlyhomesource.com and to the address in Section 26, describing the dispute, the relief sought, and your contact information; we will do the same for any dispute we have with you. The parties will attempt in good faith to resolve the dispute for sixty (60) days. Either party may request an individualized telephone settlement conference during that period. This informal process is a condition precedent to arbitration, and any limitations period is tolled while it runs.

21.2 Agreement to arbitrate

Except as provided in Section 21.5, any dispute, claim, or controversy arising out of or relating to these Terms, the Service, any Estimate, any appointment, any communication you receive (including any claim under the TCPA or any state telemarketing or privacy statute), or the relationship between us — whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, and whether arising before, during, or after termination — will be resolved exclusively by final and binding individual arbitration, and not in a court of law.

21.3 Rules, forum, and costs

Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules (or, for contractor and business claims, its Commercial Arbitration Rules), as modified by these Terms. The rules are at adr.org. If the AAA is unavailable or unwilling to administer, the parties will agree on a substitute administrator or, failing agreement, a court of competent jurisdiction will appoint one. The Federal Arbitration Act governs the interpretation and enforcement of this section. One neutral arbitrator will decide the dispute. Arbitration will take place in Maricopa County, Arizona, or, at your election, in the county where you live, or by telephone, videoconference, or documents only. For claims of $25,000 or less, you may choose documents-only arbitration. We will pay all filing, administrative, and arbitrator fees that exceed what you would pay to file in court, except where the arbitrator finds your claim frivolous. Each party otherwise bears its own attorneys' fees unless a statute or the arbitrator provides otherwise. The arbitrator may award any relief available in court to the individual party, including statutory damages and attorneys' fees where a statute provides for them, but may not award relief to or against anyone who is not a party. The arbitrator's award is final and binding and may be entered in any court of competent jurisdiction.

21.4 Class-action and jury-trial waiver

You and Home Source agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, coordinated, mass, representative, or private-attorney-general proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding. You and Home Source waive any right to a trial by jury.

If a court decides that this waiver is unenforceable as to a particular claim or request for relief, that claim or request will be severed and heard in court under Section 22, while all remaining claims proceed in arbitration. If the waiver in this Section 21.4 is found unenforceable in its entirety, then the entirety of Section 21.2 is null and void as to that dispute.

21.5 Exceptions

This section does not apply to: (a) claims that qualify for small-claims court and are brought there on an individual basis; (b) claims for injunctive or equitable relief regarding intellectual property, unauthorized access, or misuse of the Service; or (c) any dispute a controlling law says cannot be arbitrated.

21.6 Coordinated filings

If twenty-five (25) or more similar demands for arbitration are filed against Home Source by or with the assistance of the same law firm or coordinated group, the parties will ask the AAA to administer them in staged batches of no more than fifty (50) demands, each batch before a single arbitrator, with limitations periods tolled for demands awaiting their batch. This provision is intended to make resolution efficient and fair, not to deny any party a forum.

21.7 How to opt out

You may reject this arbitration agreement. Send written notice within thirty (30) days of first accepting these Terms to arbitration-optout@theonlyhomesource.com or by mail to the address in Section 26. Include your full name, the phone number and email you used, your mailing address, and a clear statement that you are opting out of the arbitration agreement. That is all it takes. Opting out has no effect on your use of the Service or on any other part of these Terms, and we will not treat you differently for doing it. If you opt out, Section 22 governs your disputes.

22.Governing Law and Venue

These Terms and any dispute arising from them are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules, except that the Federal Arbitration Act governs Section 21. For any dispute not subject to arbitration, you and Home Source consent to the exclusive personal jurisdiction and venue of the state and federal courts located in Maricopa County, Arizona, and waive any objection to that forum. Nothing in this section deprives you of the protection of any mandatory consumer -protection law of the state where you reside that cannot be waived by agreement.

The Service is directed to users in the United States. We make no representation that it is appropriate or available elsewhere.

23.Time Limit on Claims

To the fullest extent permitted by law, any claim arising out of or relating to these Terms or the Service must be filed within one (1) year after the claim arose, or it is permanently barred. Where a state does not permit shortening a limitations period, the shortest period that state permits applies instead.

24.General Provisions

Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Home Source about the Service and supersede all prior understandings, including any statement in an advertisement, on a landing page, or by a representative.

Severability. If any provision is held unenforceable, it will be modified to the minimum extent necessary to make it enforceable, or severed, and the rest remains in force.

No waiver. Our failure to enforce any provision is not a waiver of it.

Assignment. You may not assign these Terms without our written consent. We may assign them freely, including in a merger, acquisition, financing, or sale of assets.

Force majeure. Neither party is liable for failure to perform caused by events beyond its reasonable control, including natural disasters, severe weather, storms, fire, labor disputes, supply-chain failures, utility or internet outages, third-party API failures, cyberattacks, epidemics, and governmental action.

No third-party beneficiaries. Except that contractors and Blitz may enforce Sections 10, 16, and 17 as intended beneficiaries, these Terms create no rights in anyone other than you and Home Source.

Headings. Headings and summary boxes are for convenience only and do not limit the text.

Interpretation. "Including" means "including without limitation." These Terms will not be construed against the drafter.

25.Consumer Complaints

Arizona residents may contact the Arizona Attorney General's Consumer Information and Complaints Unit. California residents may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or (800) 952-5210. Complaints about contractor licensing or workmanship should be directed to the licensing agency in the state where the work was performed — in Arizona, the Registrar of Contractors.
